I. General Definitions

  • Terms of Service – these Terms of Service
  • Service – the “Sonto” online service operating at https://www.sonto.pl
  • Service Provider – the company “SONTO Sp. z o.o.” with its registered office at ul. Bagienna 36c, 70-772 Szczecin, Poland, VAT no.: 9552564863
  • User – any natural person who gains access to the Service and uses the services provided through the Service by the Service Provider
  • Electronic Communication – communication between the parties via electronic mail (e-mail) and contact forms available on the website
  • GTC-R (General Terms and Conditions of Rental) – a set of standard rules and provisions governing the rights and obligations of the parties to a rental agreement, constituting an integral part thereof
  • GTC-S (General Terms and Conditions of Sale) – a set of rules and provisions defining the terms of conclusion and performance of sales agreements between the seller and the customer, including the rights and obligations of the parties
  • Rental Agreement – an agreement under which the lessor makes an item available to the lessee for use for a specified period, and the lessee undertakes to pay the agreed rent.

II. General Provisions

  • The Terms of Service define the rules for the operation and use of the Service, and set out the scope of rights and obligations of Users and the Service Provider in connection with the use of the Service
  • The subject of the Service Provider’s services is the provision of free tools in the form of the Service, enabling Users to access content in the form of posts, articles and audiovisual materials, as well as web applications and electronic forms
  • Any content, articles and information bearing the characteristics of guidance or advice published on the Service constitute solely a general collection of information and are not addressed to individual Users. The Service Provider bears no liability for their use by Users
  • The User assumes full responsibility for the manner in which the materials made available through the Service are used, including their use in accordance with applicable law
  • The Service Provider provides no warranty as to the suitability of the materials published on the Service
  • The Service Provider bears no liability for any damage suffered by Users of the Service or third parties in connection with the use of the Service. All risks associated with the use of the Service, and in particular with the use and application of information published on the Service, are borne by the User using the Service’s services.

III. Conditions of Use of the Service

  • Use of the Service by each User is free of charge and voluntary
  • Users are required to read the Terms of Service and all other documents constituting an integral part thereof, and must accept all of their provisions in order to continue using the Service
  • Users may not use any personal data obtained through the Service for marketing purposes
  • Technical requirements for using the Service
    • a device with a display capable of rendering web pages,
    • an internet connection,
    • any web browser that renders web pages in accordance with the standards and provisions of the W3C Consortium and supports HTML5 web pages,
    • JavaScript enabled,
    • cookies enabled
  • In order to ensure the security of the Service Provider, Users and other Users of the Service, all Users should adhere to generally accepted internet security practices
  • The following actions, whether performed personally by Users or by means of software, are prohibited
    • decompiling and analysing the source code without written consent,
    • causing excessive load on the Service’s server without written consent
    • attempting to detect vulnerabilities in the Service’s security or server configuration without written consent
    • attempting to upload or inject onto the server or into the database any code, scripts or software that could damage the Service’s software, other Users or the Service Provider
    • attempting to upload or inject onto the server or into the database any code, scripts or software that could track or steal data of Users or the Service Provider
    • undertaking any actions aimed at damaging or disrupting the operation of the Service or preventing it from achieving its purpose
  • The Service is not directed to persons under 16 years of age. Persons under 16 years of age may use the Service only with the consent of a parent or legal guardian.

In the event of detecting the occurrence or potential risk of a cybersecurity incident or a GDPR breach, Users should first report the matter to the Service Provider in order to ensure prompt resolution of the problem or threat and to safeguard the interests of all Users of the Service.

IV. Communication and Provision of Other Services through the Service

  • The Service makes available tools and features enabling Users to interact with the Service in the form of
    • a contact form.
  • The Service provides the following contact details
    • e-mail address,
    • contact telephone number.
  • In the event of a User contacting the Service Provider, the personal data of Users will be processed in accordance with the Privacy Policy, which constitutes an integral part of the Terms of Service.
  • When a Service User contacts the Service Provider via the contact form, the personal data provided in the form is processed for the purpose of responding to the submitted inquiry and conducting further correspondence, in accordance with the rules set out in the Privacy Policy, which forms an integral part of the Terms and Conditions.

V. Collection of User Data

In order to provide the Service’s services properly, to protect the Service Provider’s legal interests and to ensure that the Service operates in compliance with applicable law, the Service Provider collects and processes certain data about Users through the Service. In order to provide services properly, the Service uses and stores certain anonymous information about the User in cookies.

The scope, purposes, methods and principles of data processing are set out in the annexes to the Terms of Service: “GDPR Information Obligation” and the “Privacy Policy“, both of which constitute integral parts of the Terms of Service.

  • Automatically collected data:
    For the proper functioning of the Service and for statistical purposes, certain data about the User is collected automatically. This data includes:
    • IP address,
    • browser type,
    • screen resolution,
    • approximate location,
    • subpages of the Service visited,
    • time spent on each subpage of the Service,
    • operating system type,
    • address of the previously visited subpage,
    • referral page address,
    • browser language,
    • internet connection speed,
    • internet service provider,
    • anonymous demographic data based on Google Analytics data:
      • gender,
      • age,
      • interests.
  • The above data is obtained through analytical tool scripts implemented in the Service. Some of this data (including the IP address) may constitute personal data within the meaning of the GDPR and is processed in accordance with the Privacy Policy. These tools include:
    • Google Analytics 4 (GA4) – analysis of traffic and User behavior
    • Google Tag Manager (GTM) – management of tags and scripts
    • Microsoft Clarity – session recording, heatmaps, analysis of User interactions
  • The scripts of analytical tools are activated only after the Service User has given consent via the cookie consent banner.

VI. Copyright

The Service and all copyright in the Service are owned by the Service Provider

Some of the data published on the Service is protected by copyright belonging to companies, institutions and third parties unrelated in any way to the Service Provider, and is used on the basis of licences obtained or free licences

Pursuant to the Act of 4 February 1994 on Copyright and Related Rights, it is prohibited to use, copy or reproduce in any form, or to store in retrieval systems – with the exception of Google, Bing, Yahoo, DuckDuckGo, Facebook and LinkedIn – any articles, descriptions, photographs or any other content, graphic, video or audio materials found on the Service without the written consent, or consent communicated via Electronic Communication, of their legal owner

Pursuant to the Act of 4 February 1994 on Copyright and Related Rights, plain press releases – understood as bare facts without commentary or evaluation by their author – are not subject to copyright protection. The Service Provider understands this as permitting the use of information contained in texts published on the Service, while prohibiting the copying of articles in whole or in part, unless such copying is expressly indicated in the relevant material published on the Service.

VII. Changes to the Terms and Conditions

  • The Service Provider reserves the right to introduce changes to the Terms and Conditions for important reasons, in particular:
    • changes in generally applicable laws,
    • changes to the scope or manner of providing services,
    • organizational or technical changes on the part of the Service Provider,
    • the need to adapt the content of the Terms and Conditions to the recommendations, guidelines or decisions of supervisory authorities.
  • The Service Provider shall inform Service Users with user accounts or subscribed to the Newsletter service of planned changes to the Terms and Conditions by e-mail, at least 14 days prior to the entry into force of the changes.
  • The information on changes shall include the scope of the changes together with the date of their entry into force and information on the Service User’s right not to accept the changes.
  • A Service User who does not accept the changes introduced has the right, before they enter into force, to delete their account in the Service or to unsubscribe from the Newsletter service.
  • Continued use of the Service after the changes enter into force shall constitute acceptance of the updated Terms and Conditions.

VIII. Final Provisions

The Service Provider will make every effort to ensure that the Service’s services are provided on a continuous basis. However, it bears no liability for disruptions caused by force majeure or unauthorised interference by Users, third parties or external automated programmes

The Service Provider reserves the right to modify any information published on the Service at a time of its choosing, without any obligation to notify Users of the Service in advance

The Service Provider reserves the right to temporarily, fully or partially suspend the Service for the purpose of its improvement, the addition of services or maintenance, without prior notice to Users

The Service Provider reserves the right to permanently shut down the Service without prior notice to Users

The Service Provider reserves the right to assign, in part or in full, any and all of its rights and obligations relating to the Service, without the consent of Users and without any possibility of objection on their part
